Purchasing and Refund Policy

At Zyrcled, we strive to provide our users with the best possible experience. If for any reason you are not completely satisfied with your purchase, we invite you to review our return and refund policy. The following terms apply to any product or service purchased through our application. In Spain, the right of withdrawal and refund for digital products such as monthly premium subscriptions is regulated by Law 3/2014 of March 27, amending the revised text of the Law on Consumers and Users and other complementary rules (https://www.boe.es/buscar/doc.php?id=BOE-A-2014-3329), and by the specific rules governing e-commerce, such as Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Directive 85/95/EEC and Directive 2007/65/EC and repealing Directive 97/7/EC (https://www.boe.es/doue/2011/304/L00064-00088.pdf).

 

Time limit to exercise the right of withdrawal:

The consumer has a period of 14 calendar days to withdraw from the monthly premium subscription contract without having to justify his decision or incur any cost, except for the cost of returning the product, if applicable. The period of 14 days starts to run from the day of conclusion of the contract, in the case of subscriptions with periodic payment, or from the day of receipt of the digital product, in the case of a subscription with one-off payment.

 

How to exercise the right of withdrawal:

The consumer must communicate to the seller his decision to withdraw from the contract unequivocally, by means of a written statement (e.g. e-mail, letter) or by using the withdrawal form, if any, provided by the seller. The seller must provide the consumer with information on the withdrawal procedure, including the withdrawal form, in clear and understandable language.

 

Exceptions to the right of withdrawal:

The right of withdrawal does not apply to contracts relating to:

The provision of services that are completed within a contractually specified period of time. The supply of goods or services made to the consumer’s specifications or which are clearly personalized. The supply of goods that are likely to deteriorate or expire rapidly. The supply of sealed goods that cannot be returned for health or hygiene reasons. The supply of goods which, after delivery, are mixed with other goods in such a way that they cannot be separated without detriment. The supply of accommodation, transportation, food, beverages, entertainment, events, betting and gambling services. The supply of digital content supplied immediately or downloaded on a physical medium.

 

That said, at Zyrcled Social Group S.L., we abide by the Spanish and European regulations that regulate the right of withdrawal and refund for digital products, such as our monthly premium subscriptions OR our micro payment for premium features. As a consumer, you have the right to withdraw from the subscription contract within 14 calendar days from the conclusion of the same, without having to justify your decision and without incurring any additional cost. To exercise your right of withdrawal, you must communicate your decision to us clearly and unequivocally, either by a written statement (e.g. via our customer service email) or by using the withdrawal form that we make available to you. We undertake to provide you with all the necessary information about the withdrawal procedure in a clear and understandable manner. Once we have received your notice of withdrawal, we will reimburse all payments received, including delivery costs if applicable, within a maximum of 14 days from the date on which you informed us of your decision. The refund will be made using the same means of payment that you used for the initial transaction, unless you expressly indicate another means. It is important to note that the right of withdrawal will not apply in certain cases, such as the provision of services that end within a certain period according to the contract, the provision of digital content provided immediately or downloaded on a physical medium, among other cases covered by current regulations. Micro payments (likes, revealikes, rollback):

These micro payments are considered digital consumables and, once used, are not eligible for refund. In the event that you have not used the micro payments purchased, you may request a refund within 14 days of purchase, in accordance with the right of withdrawal established in the Consumer Defense Law.

 

Right of withdrawal

As a user, you have the right to withdraw from your purchase within 14 calendar days without justification, provided that you have not made use of the Products purchased. The withdrawal period begins from the time of purchase.

 

Premium subscriptions:

Premium subscriptions automatically renew on a monthly basis, with options of 6 months (charged 5 months and one free) or one year (charged 10 months and two free). If you wish to cancel your subscription, you can do so at any time from your account settings. The cancellation will take effect at the end of the current billing period. In case you have been charged in error or have not used the premium subscription, you may request a refund within 14 days of being charged, in accordance with the right of withdrawal. To request a refund, please contact us through our customer service, providing proof of payment and subscription details.

Amazon Referral Program:

Our app participates in Amazon’s referral program, which means that some links may direct you to products on Amazon’s website. Purchases made through these links are subject to Amazon’s return and refund policies, which can be found on their official website. We are not responsible for transactions made on Amazon or products purchased through its links.

 

Third party advertisements:

Our app may display advertisements from third party companies for advertising purposes. These advertisements are not directly related to our return and refund policies, as we do not directly sell or endorse the advertised products. If you have any questions or concerns about the products or services advertised, we recommend that you contact the advertising company directly. We reserve the right to reject refund requests that we deem fraudulent, abusive or in violation of our terms and conditions. All approved refunds will be processed within 14 days of approval and will be credited to the original payment method used for the purchase. Refunds

Once we receive your cancellation request, we will proceed to the corresponding refund within a maximum period of 14 calendar days, using the same means of payment used in the original transaction. No additional charges will be applied for the refund.

Exclusions to the right of withdrawal

The right of withdrawal shall not apply in the following cases: Digital products that have been used in whole or in part, such as likes, revealikes or rollback.

Premium subscriptions once the subscription period has started.
